Heard the arguments of the learned counsel for petitioner and learned High Court Government Pleader for

the State and perused the material on record.

FIR in Crime No.63/2025 of Robertsonet Police

Station, K.G.F. is registered against 4 named accused and two unknown persons for the offence Punishable under Section 109, 115(2), 191(2), 189(2), 190, 189(4), 191(3) and 352 of the BNS, 2023.

Petitioners are arraigned as accused Nos.2 and

4 in the FIR.

It is submitted by the learned counsel that

petitioner No.2/accused No.4 has been arrested and therefore, petition has become infructuous in so far as the said accused is concerned.

Complaint is lodged by the victim by name Rahul, wherein, he has alleged that on 22.06.2025 at about 04:20 p.m., he had gone to a daba for having lunch, at that time, accused unnecessarily picked-up quarrel with him. Thereafter, at about 05:30 p.m., when he was sitting near Sri. Venkataramana temple, the said accused along with two others came in a two wheeler and all of a sudden stabbed him with a knife on his head, stomach and back and also assaulted him with hands etc, with an intention to commit his murder. Further, they abused him in filthy language and threatened him and on seeing the public, all of them fled away.

The complainant took first aid treatment at Government hospital, KGF, and then taken to SNR hospital, Kolar and to R.L. Jalappa hospital, Kolar, for

higher treatment. The statement of the victim was recorded from the hospital on the basis of which, the crime was registered.

A perusal of the complaint averments, goes to show that complainant and the accused are strangers. The incident was on account of a petty quarrel. It is alleged that accused No.1 stabbed the complainant with a knife on his head, four to five times and then petitioners and accused No.3 took the same knife and caused injuries to his abdomen. Accused No.5 is alleged to have caused injuries on his back with the same knife and two others assaulted him with hands.

As per discharge summary, the victim is stable and satisfactory. Petitioner No.1/accused No.2 is a young boy aged 22 years. It is submitted that accused No.1 has been granted bail by the Sessions Court. Petitioner has no criminal antecedents. The apprehension of the prosecution that he may not cooperate with the investigation and he may tamper with the prosecution witnesses etc. can be

safeguarded by imposing necessary conditions. Hence, the

i) Petition is partly allowed .

ii) Petition in respect of petitioner No.2/accused

No.4 is dismissed as having become infructuous .

iii) Petition in respect of petitioner No.1/accused

No.2 is allowed .

iv) In the event of arrest of petitioner No.1/accused No.2, in Crime No.63/2025 of Robertsonpet Police Station, K.G.F, he shall be released, subject to following conditions:

a) He shall appear before the Investigating Officer within one week from the date of receipt of a copy of this order and shall execute a bond for a sum of Rs.50,000/(Rupees fifty thousand only) with two sureties for the likesum.

b) He shall furnish proof of his residential address/contact number and shall inform the I.O. in case of change in the address/contact number.
