This petition for bail is preferred by the accused in Crime No.14/2024 of Kanakapura Rural Police Station, registered for offence punishable under Section 302 of IPC.

It is the case of prosecution that on 30.01.2024 at about 10:00 p.m., accused came home consuming alcohol. His son, deceased Govindaraju, when called him for dinner, accused demanded him to get liquor and slapped him. Deceased assaulted and pushed the accused. Accused went away and returned to the house at about 12:30 a.m. and dropped a big stone on the head of the deceased, who was sleeping in the veranda, on account of which he sustained grievous bleeding injuries. He was shifted to the hospital, however, succumbed to the injuries on the next day.

As per postmortem report, death was due to coma as a result of head injury sustained. Deceased has sustained about 13 injuries. CWs.2 to 4 are the eye witnesses to the incident. In view of their statements, there is a prima-facie case against the petitioner. Offence committed is punishable with death or imprisonment for life.

The learned Additional SPP has submitted that the trial has commenced. The eye witnesses are yet to be examined and therefore, at this stage, if the petitioner is enlarged on bail, there are chances of tampering the eye witnesses. Petition is dismissed .
