This contempt petition is filed alleging the willful disobedience of the order dated 05.02.2024 passed in W.P.No.27029/2023. The operative portion of the order reads as under:

"i) The writ petition is allowed.

¶27

ii) Respondent No.3 is hereby directed to consider the representation dated 28.07.2023 bearing in mind the directions issued by this Court as well as respondent No.2-Director as per Annexure-T3 within a period of six weeks from the date of receipt of certified copy of this order.

iii) Respondent No.3-Management, which is solely responsible for inaction shall pay cost of Rs.25,000/- to the petitioner within a period of two

weeks from the date of receipt of certified copy of this order."

We have perused the affidavit filed by the

accused. The affidavit dated 13.08.2025 indicates that they have considered the representation as directed by the learned Single Judge and have forwarded a report to the government indicating the entire incident.

The learned counsel for the accused has also pointed out that the complainant had assaulted a child in the Special school and due to his abusive behaviour towards the children, the donors were compelled to intervene, after which the complainant voluntarily stopped attending the school. It is submitted that the complainant’s continued absence is solely attributable to his violent and abusive conduct towards the mentally challenged children under their care, which was wholly unacceptable and led to his discontinuance from duty and this aspect has also been reported to the government.

The learned counsel for the accused submits that

all the arrears of salary have been paid and today he is

handing over the demand draft for the balance amount of Rs.49,488/- which is the outstanding due of salary for a period of 47 days. It is further submitted that there are no pending salary dues except for the aforementioned 47 days, which have already been cleared through the demand draft. However, the learned counsel for the complainant submits that he has to seek instructions in the matter and can't accept the demand draft.

After perusal of the affidavits filed by the respondent/accused, we are of the considered view that there is no willful disobedience of the order of the learned Single Judge. Accordingly, the contempt proceedings are dropped .

Notice issued to the accused is discharged.
