ORAL ORDER

M/s Automotive Axles Ltd., has approached this Court assailing the legality and correctness of the order dated 19.07.2013 in Application No.19/2009 passed by the Labour Court, Mysore (herein after referred to as "Labour Court" for short), whereby, the Labour Court by the impugned order has allowed in part, the application under 33-C(2) of the Industrial Disputes Act 1947 (herein after referred to as "ID" Act for short), directing the petitioner to pay stipend amount of Rs.41,900/- with interest @ 6% from the date of petition till the date of entire realization to the applicant.

Learned counsel for the petitioner submits that the petitioner is ready and willing to pay stipend amount of Rs.41,900/-, however, seeks to forego the interest @ 6% imposed by the Labour Court.

Learned counsel for the respondent submits that the petitioner be directed to pay an amount of

Rs.50,000/- towards the full and final settlement of their claim.

In the peculiar facts and circumstances, without

adverting to the merits and demerits of the case, as the parties have showed inclination to resolve the dispute, this Court deems it appropriate to direct the petitioner to pay a sum of Rs.45,000/- towards full and final settlement of the claim of the respondent, and the said amount to be paid within period of four weeks from the date of release of this Order. Accordingly, the writ petition stands disposed of.
