OR IN THE NATURE OF MANDAMUS, DIRECTING THE R-1 TO EXTEND THE COURSE OF THE PETITIONER BY A PERIOD OF 1 YEAR OVER AND ABOVE THE PRESCRIBED COURSE COMPLETION PERIOD OF 8 YEARS, AS CONTAINED IN O.B.6.2 OF THE R-1 REGULATIONS AND ISSUE A SPECIFIC DIRECTION TO THE R-2 COLLEGE IN THIS REGARD, PERMITTING THE PETITIONER TO ENROL FOR HIS 7TH SEMESTER AND 8TH SEMESTER, ALONG WITH PERMISSION TO WRITE THE 7TH SEMESTER EXAMINATION AND CONTINUE WITH INTERNSHIP IN THE 8TH SEMESTER AND ETC.

THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, THE COURT MADE THE FOLLOWING:

ORDER

The petitioner is before this Court seeking for the following reliefs:

i. Issue a writ in the nature of Mandamus or in the nature of Mandamus, directing the first respondent to extend the course of the petitioner by a period of 1 year over and above the prescribed course completion period of 8 years, as contained in O.B. 6.2 of the 1^st Respondent’s Regulations and issue a specific direction to the second respondent college in this regard, permitting the petitioner to enrol for his 7th semester and 8^th semester, along with permission to write the 7^th semester examination and continue with the internship in the 8^th semester.

ii. To issue a writ in the nature of Mandamus directing the first and second respondents to permit the petitioner to pay the fees for admission, examination of 7^th semester and allow the petitioner to attend classes and participate in his internship during the 8^th semester and;

iii. Grant any other incidental or consequential reliefs as may be just.

This Court vide interim order dated 23.02.2022 had permitted the petitioner to take up the examination. In pursuance of which, he has so taken up the examination and on verification, it is submitted that he has cleared the examination.

In that view of the matter, considering that the petitioner has taken up the examination in terms of the interim order passed by this Court, he cannot be deprived of the Degree Certificate in respect thereto. Hence, I pass the following:

i) Respondent No.2 - college is directed to upload and forward all the documents pertaining to the petitioner to the respondent No.1 - University within a period of four weeks from today.

ii) Respondent No.1 is directed to award the necessary Degree Certificate to the petitioner if all other compliances are made within a period of seven weeks from today.
