The brief facts is that one Smt. K. Seema Magi, Assistant Controller was caught on camera by a journalist while accepting bribe from the owner of a petrol bunk and the said journalist is said to have lodged a written complaint and also downloaded the video on a CD and handed over to the petitioner who was officiating in the post of Deputy Controller and on that basis the petitioner after having viewed the CD and the written complaint is said to have recommended for action against the officer by the ACB and has also recommended for suspension of the said officer. It appears, that the journalist, from the electronic media, has telecast the same and in the course of telecast he has referred to the name of the petitioner. The Department, offended by the same, has proceeded to suspend the officer i.e., the instant petitioner. The petitioner appears to have addressed a legal communication to the news channel and in reply the news channel has endorsed the fact that neither any comment nor information has been shared with them by the petitioner. Despite the same the petitioner has been proceeded against and has been suspended from his post. Aggrieved by the same he has approached the Tribunal and the Tribunal, opted to hold that as the said investigation is under way no interference is warranted despite the legal notice and endorsement by the news channel having been placed before the Tribunal.
