Memo dated 09.10.2023 is filed by learned counsel for respondent which reads as follows:

“The undersigned most respectfully submits that in view of the settlement arrived between the parties as per the compromise petition dated 14/08/2023 in F.D.P. No. 03/2012 on the file of Principal Civil Judge and JMFC, Malur, the above appeal does not survive for consideration. A copy of the final order together with the compromise petition is herewith filed for the kind perusal of this Hon'ble Court, the same be taken on record and the above appeal be disposed of, in the interest of justice and equity”.

Along with the memo, order sheet of FDP No.3/2012 on the file of Principal Civil Judge and JMFC., Malur is also enclosed. Before the FDP Court, the parties have entered into compromise under Order 23 Rule 3 of Code of Civil Procedure,
