“The petitioner has filed the above writ petition challenging the order dated 13.02.2023 passed by the Respondent No.2 herein, rejecting the representation dated 04.01.2023 given by the petitioner, for waiver of interest imposed on the alleged balance land cost. During the pendency of the above Writ petition, the Respondent No.2 has issued possession certificate dated 07.06.2024 and execute lease cum sale agreement dated 24.06.2024 in favour of the petitioner herein. In the registered Lease cum Sale Agreement, it is stated that the issue/subject regarding waiver of interest/levy of interest for the delayed payment of balance tentative cost of land, will be placed before the sub-Committee/KIADB Board meeting. Further the Respondent No.2 has executed Lease cum Sale Agreement in favour of the Petitioner, subject to withdrawal of the above Writ Petition. The copy of the Lease cum Sale Agreement and Possession Certificate are produced herewith for the kind perusal of this Hon’ble Court.
