The plaintiff contends that the portion that fell to the share of Sri Narayanappa and Sri Nagaraja, adjoined a public road running from Begur to Hulimavu on the northern side, while the other portions were located on the southern side of the portion, allotted to the share of Sri Narayanappa and Sri Nagaraja. The plaintiff claimed that after the death of Sri Balappa, his wife sold the portion to the plaintiff and that the plaintiff is in possession of 2 acre 24 guntas. He claimed that at the time of partition, it was specifically agreed " that an area measuring about 25 feet width on the eastern side of the land that fell to the share of the defendants should be left as approach road to the portion fallen to the share of others ". He contends that even before effecting partition prior to the year 1977, an area measuring 20 feet width running around eastern side of the land was exclusively used as approach to reach the southern edge of the land. The plaintiff therefore claimed that he is entitled to an easementary right over the passage on the eastern side of the land bearing Sy No.368/1 and therefore, sought for the aforesaid reliefs.
