the possession of the suit schedule property but the defendant had dragged on to vacate the same on one or the other reason. Thereafter, on 25.07.2012, when the plaintiff entered into the suit schedule property with an intention to cultivate the same, the defendant tried to obstruct for the same. Hence, the plaintiff has filed the suit. In pursuance of the suit summons, the defendant appeared and filed the written statement contending that the defendant had purchased the suit schedule property by Shivanandappa in the year 1996 for sale consideration of Rs.38,400/-. Consequently, Shivanandappa had executed the sale agreement on 21.10.1996 and handed over the possession of the suit schedule property to the defendant. Since the khata was not got mutated in the name of the Shivanandappa, regular sale deed was not got registered in his favour. But the defendant is in possession of the property in terms of the sale agreement.
