Second wife by name Smt.Akkamma, who is no more and who has got only one son by name late Bhoopala Gowda, who is also no more, who is none other than the father of the plaintiff Nos.1 and 2. It is their case that the grandfather Subbaraya Gowda had acquired the suit schedule property by virtue of a registered sale deed dated 14.11.1962 and ever since, he has been in possession and enjoyment of the property. The vendors of grandfather of the plaintiff namely Munishamappa and Byranna have started interfering with the peaceful possession and enjoyment of the land. As such, the grandfather of the plaintiffs filed a suit in O.S.No.85/1969 on the file of then Muncif at Doddaballapura against Munishamappa and his brother Byranna, who are the sons of late Erappa and others i.e., the vendors of Munishamappa and Byranna namely late Hanumanthappa and the said suit came to be decreed on 26.11.1978.
