Learned counsel for petitioner is present along with the petitioner-accused. He files a memo along with a copy of Demand Draft for having handed over the same to the respondent along with an acknowledgement of learned counsel for respondent with interest amount of Rs.7,900/- that has been paid for delay caused in making the payment of the balance amount.

Learned counsel for petitioner files this application under Section 70(2) of Cr.PC.

The application is perused. The cause and reasons assigned in the said application is accepted.

In view of the fact that the petitioner had not made good the payment, due to which NBW was issued. Now, the entire payment is made to the respondent by way of Demand Draft including the interest. Accordingly, IA.No.2/2025 is allowed .

The NBW issued against the petitioner-accused is hereby recalled.
