Heard Sri Vivek N., learned counsel for the petitioner and

Sri Channappa Erappa, learned High Court Government Pleader for the respondent/State.

Successive bail petition is filed by the

petitioner/accused No.1.

¶25

Petitioner has challenged the offence under Section 498A and 302 IPC.

From the date of rejection of the earlier bail request

to the present petition, the only progress that has been taken place in the case is that trial has commenced and majority of the prosecution witnesses have not supported the case of the prosecution.

Learned counsel for the petitioner submits that three more material witnesses are to be examined and therefore, continuation of the accused/petitioner in the judicial custody is no longer warranted.

Per contra, learned High Court Government Pleader

by filing written objections opposes to grant of bail contending that there are three more material witnesses evidence relevant

to the case on hand is to be commenced and if the accused is enlarged on bail, there is a possibility of tampering the prosecution witnesses which has already taken place in respect of the prosecution witnesses and therefore, sought for rejection of the bail.

Taking note of the fact that charge sheet is filed for the offence punishable under Section 302 IPC, though it was alleged as under Section 306 IPC and death of the deceased was taken place on account of poisoning, this Court is of the considered opinion that directing the prosecution to expedite the trial and conclude the examination of three more material witnesses would meet the ends of justice and thereafter matter can be disposed of within the time manner.

Criminal petition is rejected.

Trial Court is directed to expedite the trial and conclude

the trial on or before 30^th November 2024.
