It is further alleged that thereafter, the accused Nos.1 and 2 conspired to eliminate CW-1 and his deceased brother and 5 months prior to the alleged incident with the assistance of accused No.3 to 5, they secured CW-1 and his brother near Tamaring Hotel, Rammamurthy Nagar at 11.30 pm in order to commit his murder, but in view of the arrival of Hoysala Police they were not successful. It is alleged that on 24.10.2020 at about 7.00 pm, accused No.3 on the instructions of accused No.1 secured CW-1 and deceased under the guise of settlement of the dispute and made them to consume alcohol and thereafter, by securing the weapons, accused No.1 has stabbed the deceased and the complainant by knife by causing the death of the deceased and attempted on the life of the complainant. In this regard, a complaint was lodged by complainant who is an eye witness. On the basis of the complaint, the petitioner who arraigned as accused No.2 is apprehended and was remanded to custody. Subsequently, the investigation officer completed the investigation and submitted the charge sheet. Later on the matter was committed to the learned Sessions Judge and the charge was also framed and the trial is in progress.
