The order brought under contempt is the directions in Writ

¶29

Petition No.29350 of 2013 dated 20.09.2023.

The following directions are issued by the learned Single Judge,

“43. ..... The petitioner would have to be reinstated into service forthwith and he would also be entitled for continuity of service and all consequential benefits.

As far as backwages are concerned, having regard to the fact that the petitioner has been unfairly victimized and has been subjected not only to departmental, but also a criminal proceeding at the instance of CPRI, despite the fact that the authenticity of the Caste Certificate that he had produced was established way back in the year 2005, in my view, it would be appropriate to award 25% backwages to the petitioner.”

A bare reading of the aforesaid directions indicate that no time limit is prescribed by the learned Single Judge. At this stage, it could not be said that the respondents have committed willful disobedience or contempt of the Court.

At the same time, the directions of the Court should not go uncomplied. The respondent-authorities are expected to comply the directions of the Court within a reasonable time. The respondents having not done so, the respondents are to be directed to comply the directions within six weeks from today. The complainant is reserved liberty to invoke the contempt jurisdiction, if the order of the learned Single Judge is not complied as directed above.

With the above observations, the contempt petition is disposed of.
