The petitioners are before this Court seeking the following

prayer:

“a. Issue a Writ of Mandamus directing the Respondent No.1 to consider the Representation

of Petitioners dated 17.01.2023 vide ANNEXURE – E seeking adequate police protection.

b. Issue Writ of mandamus directing the Respondent No.2 to consider the Representation of petitioner dated 17.01.2023 vide ANNEXURE – E1 seeking adequate police protection.

c. Issue a Writ of Mandamus directing the Respondent No.3 to consider the Representation of Petitioner dated 17.01.2023 vide ANNEXURE – E2 seeking adequate police protection.

d. Issue a Writ of Mandamus directing the Respondent No.4 to consider the Representation of Petitioner dated 17.01.2023 vide ANNEXURE – E3 seeking adequate police protection.]

The prayer in effect is that, the petitioners are complainant Nos.1 and 2, alleging that the accused named in the complaints dated 17.01.2023, has committed offence and seek appropriate relief. The complaints though narrate several circumstances against the accused, the relief sought is documents that the accused has taken away be secured and returned to the complainants.

Learned Additional Government Advocate would submit that action would be taken upon the complaints submitted by the petitioners strictly in accordance with the judgment rendered by the Apex Court in the case of LALITHA KUMARI V. GOVERNMENT OF UTTAR PRADESH reported in (2014) 2 SCC 1, if reasonable time is granted .

Placing the submissions on record, I deem it appropriate to direct the Station House Officer or the Officer incharge of the concerned police station - respondent No.2 herein, to take appropriate action in terms of the judgment in the case of LALITHA KUMARI (supra), within two weeks from the date of receipt of a copy of the order.

With the aforesaid direction, the writ petition is disposed.
