Smt.H.R.Renuka., learned counsel for the petitioner and Sri.S.B.Mukkannappa., learned counsel for the respondent have appeared in person.

Learned counsel jointly submits that a joint memo has been filed stating that the parties to the proceedings have agreed to settle the case. Counsel therefore, submits that the joint memo may be placed on record and the order dated:14.07.2021 passed by the III Addl. Labour Court, Bengaluru in Application No.06/2013 may be modified in terms of the joint memo.

Submission is noted. Joint memo of settlement is placed on record. It reads as under:

The parties to the proceedings have agreed to settle the case, consequently the orders at Annexure-'B' dated:14.07.2021 passed by the III Addl.

Labour Court, Bengaluru in Application No.06/2013 may kindly be modified as under:

The petitioner Corporation to pay the respondent a lumpsum of Rs.6,00,000/- (Rupees Six Lakhs only) in full and final settlement of the claim arising from the order under challenge.."

Learned counsel Smt.H.R.Renuka., submits that in terms of the order dated:14.02.2022 passed by this Court, the Corporation has deposited a sum of Rs.3,00,000/- (Rupees Lakhs only) vide cheque No.847415 dated:11.03.2022 drawn on Canara Bank and the cheque has been handed over to the counsel representing the respondent.

Sri.Rajappa - the respondent is present before the Court and he has been duly identified by his counsel Sri.S.B.Mukkannappa.

When queried by this Court, Sri.Rajappa - the respondent submits that he has understood the contents of the joint memo and has agreed for the settlement and he also acknowledges that he is in receipt of a sum of Rs.3,00,000/- (Rupees Three Lakhs only).

The Corporation has agreed to pay a lumpsum of Rs.6,00,000/- (Rupees Six Lakhs only) in full and final settlement of the claim arising from the order under challenge. Taking note of the fact that the respondent is in receipt of Rs.3,00,000/- (Rupees Three Lakhs only), the Corporation is directed to pay the balance amount of Rs.3,00,000/- (Rupees Three Lakhs only) to the respondent within four weeks from today.

Resultantly, the order dated:14.07.2021 passed by the III Addl. Labour Court, Bengaluru in Application No.06/2013 vide Annexure-'B' is modified in terms of the joint memo.

As a result, the Writ Petition is disposed of .
