2. On the basis of recommendations of the District Waqf Officer, a committee was constituted on 1809-2017. Subsequently, it was brought to the notice of the board that, most of the members of the committee are in unauthorized occupation of the Waqf Property. In this regard, after receipt of complaints, Enquiry under section 54 for removal of the encroachment action initiated notice under From No. 66 was issued to all the person who are in unauthorized occupation of the said property, they are 21 in numbers, it is there in the file. So after the examination of the list of encroachers it is found that 7 persons viz., 1) Syed Akhil Sha Hussaini, 2) Syed Sadath Hussaini, 3) Syed Shafiulla Hussaini, 4) Syed Mutuza Hussaini, 5) Syed Zikriya Hussaini, 6) Syed Zainullabdin Hussaini and 7) Syed Noorulla Hussaini are found in the list of encroachers now they are facing the enquiry under Section 54 of the Waqf Act. After coming to know of this fact, show cause notice was issued to all the 7 members why they should not be removed from the committee under Section 64(1)(k) of the Wakf Act, 1995 as amended 2013. This notice was served on them, they have questioned the show cause notice before the Hon'ble High Court of Karnataka in the above said Writ Petition wherein the Hon'ble Court was pleased to pass the following order:
