he has deposed in the same line of PW.1. Though it is the case of the plaintiff that her husband had purchased a site measuring 30 ft X 40 ft under the sale deed, the plaintiff has not produced any evidence. In addition to this, the husband had purchased more than the measurement shown in the sale deed. Further, Madaiah had filed a suit in O.S.No.216/1997 before the Additional Civil Judge (Jr.Dn.), Shimoga for the relief of a permanent injunction against several other persons including the plaintiff. The claim of the said Madaiah was that, out of the larger extent, he has purchased a portion of property measuring 30 ft X 40 ft in 'A' schedule property at its eastern portion. The said suit was decreed in favour of Madaiah that suit schedule 'A' property measures 30 ft X 60 ft which extends up to the Channel on the eastern side and the same boundary was mentioned in the schedule as well. The defendants are the legal heirs of the deceased Madaiah. After the death of Madaiah, the defendants are in possession and enjoyment of the schedule properties.
