enough material to establish there was a transaction between the petitioner and the respondent and that the cheque in question was issued for discharge of the said liability. The respondent has claimed that the petitioner had availed a hand loan of Rs.30,00,000/-, while the petitioner claimed that she had availed a hand loan of Rs.22,50,000/-. The petitioner herself had lodged a complaint before the Police at Ex.P13 where she categorically admitted that she had raised a hand loan of Rs.30,00,000/- from the respondent and that she was liable to pay a sum of Rs.19,60,000/- to the respondent. This document is not denied by the petitioner. Following this complaint, the respondent also lodged a complaint on 10.11.2008 claiming a sum of Rs.19,60,000/- from the petitioner. The petitioner did not dispute the fact that the cheque in question was drawn from her account and did not dispute her signatures found on the cheque in question. Having regard to the balance sheet of the petitioner which showed that for the assessment year 2008-09, the petitioner had an unsecured loan of more than Rs.39,00,000/-, it is probable that the cheque in question was handed over by the petitioner to the respondent towards discharge of a debt.
