THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA READ WITH SECTION 482 OF CR.P.C., PRAYING TO QUASH THE LOOKOUT CIRCULAR RAISED BY R3 AGAINST THE PETITIONER IN CONNECTION WITH THE CRIME NO.58/2021 OF EAST ZONE WOMEN POLICE STATION AND ETC.,

The petitioner is before this Court calling in question the lookout circular notified by the 3^rd respondent against the petitioner in connection with Crime No.58/2021 registered for offences punishable under Sections 506, 498A, 307, 323 of the IPC and under Sections 3 and 4 of the Dowry Prohibition Act.

Heard Sri.P.P.Hegde, learned senior counsel appearing for petitioner and Smt.Yashodha.K.P, learned High Court Government Pleader appearing for respondents.

In the case at hand, the police, after investigation, have filed a charge sheet in C.C.No.12953/2021 which were called in question before this Court in W.P.No.17939/2021 and this Court by an order dated 08.10.2021 has granted an interim order of stay of the proceedings in C.C.No.12593/2021.

The petitioner was arrested on 19.04.2021. After his arrest and the interim order granted by this Court, the petitioner has made several representations for recall of the said lookout circular to all the powers that be. They were made on 1.11.2021, 25.01.2022, 19.02.2022 and 28.02.2022. Despite these representations, the circular has not been withdrawn, which drives the petitioner to this Court in the subject petition.

The learned High Court Government Pleader would

submit that the circular was issued on 07.04.2021 which would remain in force for a period of one year and it has spent itself. However, on instructions, she would submit that the steps for recall of the lookout circular has been initiated and would within the next two weeks be recalled.

Accepting the submission of the learned High Court Government Pleader would mean nothing further would survive in the subject petition. Therefore, recording the submission made by the learned High Court Government Pleader that the circular would be withdrawn in the next two weeks, I deem it appropriate to dispose the petition with a direction to the respondents to recall the lookout circular within the next ten days from the date of receipt of the copy of this order.

With the aforesaid directions, the petition stands disposed.
