THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECT THE R-2 TO CONSIDER THE REPRESENTATION OF THE PETITIONER DATED 02.11.2018 FOR TRANSFER OF KATHA INTO HIS NAME PRODUCED AT ANNEXURE-A AND ETC.

Heard the learned counsel appearing for the parties.

Petitioner claims that the property bearing Municipal

Khatha Assessment No.224, measuring 20 x 30 feet, situated at Nukulabande, Mulbagal Town, was allotted to the father of the petitioner by the respondent No.2 on 24.01.1989 and in pursuance of the same, the katha was registered in favour of the petitioner's father in respect of the subject property. After the death of his father, the petitioner submitted an application to transfer the katha in his favour in respect of the subject property. Petitioner's grievance is that the said representation has not been considered.

The petitioner has submitted the representation dated 2.11.2018 for transferring the katha standing in the name of his father, in his favour. Hence, the respondent No.2 is under an obligation to consider the representation submitted by the petitioner.

Therefore, it is expedient to dispose of the writ petition directing the respondent No.2 to consider the representation/application dated 2.11.2018 submitted by the petitioner at Annexure-A and pass appropriate order in accordance with law within a period of eight weeks from the date of receipt of certified copy of this order.
