THIS WRIT PETITION IS FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA PRAYING TO QUASH THE POLICE NOTICE DATED 6.6.2015 ISSUED BY THE R-3 VIDE ANN-A AS ARBITRARY ILLEGAL AND UNJUST AND ALL FURTHER PROCEEDINGS IN NCR NO.197/2015 OF THE VIDHANA SOUDHA POLICE STATION, BANGALORE REGISTERED ON TE BASIS OF THE FALSE COMPLAINT GIVEN BY THE R-4 AGAINST THE PETITIONER AND ETC.,

THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, THE COURT MADE THE FOLLOWING:

This petition is disposed off as having become

infructuous in terms of the Memo dated 12/09/2022 filed in

the Court, which reads as under:

" The petitioner above named humbly submits as follows:

1. On 22.06.2015 this Hon'ble Court was pleased to direct the learned Government Advocate to take notice on behalf of the respondents 1 to 3. In the evening of 22.06.2015 at about 7 to 7.30 P.M., the Inspector of Police / Station House Officer of Vidhana Soudha police called the petitioner as well as Mr. Vasanth Seth and closed the entire case in NCR No.197/2005. The amount of Rs.2,00,000/- (Rupees Two Lakhs only) was also returned to the petitioner and to this effect they have collected an acknowledgement from the petitioner.

In view of the matter, the petitioner submits that prayer (a) in the Writ Petition does not survive, in so far as it relates to quashing the Police Notice i.e. Annexure - A or the further proceedings in NCR No.197/2015 of Vidhana Soudha Police Station, Bangalore, registered on the basis of the false complaint given by the 4th respondent against the

petitioner. Accordingly, the prayer (a) would not survive i.e. calling for the records from Vidhana Soudha Police Station in NCR No.197/2015 so as to demonstrate before this Hon'ble Court the illegal acts restored to by the 4th respondent, Sri. Shiva Shankar, who has abused his official position as Inspector of Police, Karnataka Lokayukta Police as detailed in the above petition.

WHEREFORE, the petitioner prays that this Hon'ble Court be pleased to take this Memo on record and dismiss the same as infructuous in the interests of justice and equity."
