THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUION OF INDIA PRAYING TO QUASH THE IMPUGNED ENDORSEMENT DATED 02.04.2014 ISSUED BY R-2 DEPUTY SECRETARY AT ANNEX-E AND ETC.,

THIS WRIT PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:

The petitioner is before this Court seeking for the following reliefs:

a) "Issue a writ in nature of Certiorari quashing the impugned endorsement dated 02.04.2014 vide No.BDA/A/Uka/2013-14 issued by the 2nd respondent Deputy Secretary at Annexure-E.

b) Issue writ in the nature of Mandamus directing respondents to cancel the allotment if any made in favour of the land owner with respect to the site No.1003, at Arkavathi Layout, VII-Block measuring 9 x 12 meters.

c) Pass such other order/further orders as this Hon'ble Court deems fit under the facts and circumstances of the case.

The acquisition under challenge is relating to Arkavathi Layout.

A Co-ordinate Bench of this Court in W.P.No.51929/2014 dated 27.09.2021 has disposed of the matter relating to allotment of sites and cancellation thereof as in terms of paragraph-61(9) and directed the State to appoint a Committee to look into the grievance of the land losers.

In view thereof, I am of the considered opinion that the said order passed by the Co-ordinate Bench would be equally applicable to the present case and as such, I pass the following:

ORDER

i. The petitioner is permitted to submit a representation to the Committee in pursuance of the direction issued in Writ Petition No.51929/2014 dated 27.09.2021, within two weeks from the date of receipt of copy of this order.

ii. The Committee is directed to consider the said representation within four months from the date of such receipt of the representation.

iii. Writ petition is accordingly disposed of.
