Sri.T.M.Lokeshappa is working as Police Constable in 3rd respondent-Karnataka State Reserve Police (for short “KSRP”), 9th Battalion. The petitioner had rented a house at Jayanagar (Byrasandra) and her two daughters are studying 10th and 5th standards at Opthalic Carmel School, Thilaknagar, Jayanagar East, Bangalore and her son is studying in St.Francis School, Koramangala, Bangalore. Since the husband of the petitioner was allotted KSRP Police Quarters, the 3rd respondent addressed a letter dated 03.08.2010 to the petitioner for recovery of House Rent Allowance paid to the petitioner on the ground that when both the husband and wife are in government service, they would be entitled for one House Rent Allowance. Accordingly, Annexure-F order dated 28.10.2010 was passed to recover a sum of Rs.1,24,167/from the petitioner towards House Rent Allowance from her salary.
