Aggrieved by the appointment of respondent No.5 as the Anganwadi Worker to Sagare Anganawadi Centre 83, instead of the petitioner, the petitioner has filed the instant writ petition.

The case of the petitioner is that, she is a widow and as per the guidelines for appointment of Anganawadi Worker, widow has to be given preference if she is otherwise eligible and that respondent No.3, in spite of the petitioner being a widow, has chosen respondent No.5 as the Anganawadi Worker.

Respondents No.1 to 4 have filed objections and it is submitted that, though the petitioner is a widow, she is not otherwise eligible for being appointed to the post of Anganawadi Worker. As per the guidelines, Anganawadi worker requires to have passed S.S.L.C with Kannada as the first language or second language, and in the case of petitioner, she has passed S.S.L.C with Marathi and English as the first language and second language respectively and

Kannada as the third language. The guidelines prescribing Kannada as the first language or second language to be studied by the Anganawadi Worker in S.S.L.C., is not challenged by the petitioner herein. Under the circumstances, the petitioner becomes ineligible to be appointed as Anganawadi Worker.

For the aforementioned reasons, writ petition is hereby dismissed.
