O R D E R

The petitioner is facing trial in S.C.No.315/2019 on the file of the Principal District & Sessions Judge, Bengaluru Rural District, Bengaluru, for the charges of commission of murder etc.,

It is alleged that on 23.07.2019 at 7.30 p.m. the petitioner and other accused being members of unlawful assembly in execution of their conspiracy to commit murder of one Narasimha Yadav @ Narasimha, assaulted him with deadly weapons in Tunganagar and committed his murder.

The bail applications of other co-accused were dismissed by this court. The petitioner filed criminal petition No.142/2021 for temporary bail on medical ground. That was allowed by this Court on 25.03.2021 granting temporary bail for 90 days. Thereafter, he surrendered before the Trial Court.

Again he has filed the above petition claiming that his wife is due for delivery and to attend her natal care, he be granted bail for two months. In support of the said contentions, learned counsel for the petitioner has submitted the medical records of his wife and the ration card. The said records show that Divya, wife of petitioner is due for delivery and the estimated date of delivery is 09.02.2022. Apart from his wife, he has father and mother. However, during hospitalization, his attendance is required.

Therefore, the petition is partly allowed. The petitioner is granted bail in S.C.No.315/2019 on the file of the Prl. District & Sessions Judge, Bengaluru Rural District, Bengaluru for a period of 30 days. He shall be released on bail in the said case for a period of 30 days subject to the following conditions:

(i) He shall execute personal bond for a sum of Rs.25,000/- and furnish two sureties in the likesum to the satisfaction of the Trial Court;

(ii) He shall appear before the Trial Court regularly.

manner.

(iv) He shall surrender before the Trial Court soon

after 30 days of his release.
