The learned counsel appearing for the accused has tendered an affidavit of the accused. In paragraph 4, the accused has tendered an unconditional apology and has stated that he has withdrawn the statements made in the counter affidavit and especially, what is stated in paragraphs 5 and 6 thereof.

There is no dispute that the order of which breach is alleged is now complied with by the accused by granting one grace mark to the complainants subject to the result of the writ appeal. However, the learned counsel appearing for the accused states that when the statement of marks was issued to the complainants, a writ appeal was pending. He further states that now the writ appeal has been dismissed and therefore, a fresh statement of marks will be issued by the accused by deleting the remark that the statement of marks is subject to the outcome of the writ appeal.

We accept the said assurance. In view of the belated compliance and the apology tendered by the accused for the delay as well as for making the statements which have been made in paragraphs 5 and 6 of the counter affidavit, no further action is required to be initiated under the Contempt of Courts Act, 1971. Accordingly, the contempt petitions are disposed of. However, the accused shall ensure that the corrected statement of marks will be issued to the complainants at the earliest.
