We have perused the affidavit filed by the first accused. A copy of the endorsement dated 23^rd December 2020 has been annexed to the said affidavit by which, the claim of the complainant for being appointed on compassionate grounds has been rejected.

The learned counsel appearing for the

complainant has something to say about the correctness of the said endorsement.

3. However, the issue of correctness of the

endorsement cannot be gone into in this contempt petition. There is a delay on the part of the accused in complying with the order of this Court. The first accused has tendered an unconditional apology for the said delay. The apology deserves to be accepted.

By accepting the apology, the contempt petition is disposed of. However, it will be open for the complainant to file appropriate proceedings to challenge the aforesaid endorsement.
