para 3 of the affidavit shows that the claim petition filed by them was dismissed and they were unable to maintain themselves and were under the impression that they have to go to Bangalore to file an appeal. Whereas the fact remains that the claim petition filed by the appellants along with his mother and brother under Section 166 of the Motor Vehicles Act, 1988, claiming compensation for the death of their father, who was aged more than 60 years, came to be allowed and an award of Rs.2,23,000/- with interest at 6% per annum has been awarded and the amount has been deposited by the insurer in the month of August 2010 within five months from the date of passing of the award. When such being the case, the question of suffering financial crisis does not arise and they have already withdrawn the amount along with interest. Appellants’ mother-wife of the deceased is said to be died and these claimants being her legal heirs received the amount awarded to their mother.
