02/ 11.02.2026: Heard, learned counsel for the parties.

By way of filing this writ petition, the petitioner has sought for the following reliefs:-

(A) For issuance of appropriate writ(s), order(s), concerned direction(s) upon the concerned respondents to grant the petitioner promotion from Grade-1 to Grade-2 with effect from 24.12.2015, i.e. on the date he became eligible for time bound promotion after completion of satisfactory service for 12 years as per the Primary School Teacher Promotion Rules, 1993 (herein after the 1993 Rules). (B) For issuance of appropriate writ(s), order(s), direction(s) upon the concerned respondents to pay him the arrear of salary in the enhanced Grade-2 scale from 24.12.2015 till the date of his superannuation i.e. 28.02.2023.

(C) For issuance of appropriate writ(s), order(s), direction (s) upon concerned respondents to revise the pension the present petitioner accordingly after granting him promotion in Grade-2 with effect on 24.12.2015 under the Rules of 1993.

(D) For issuance of appropriate writ(s), order(s), direction(s) upon the concerned respondents to pay the arrears of enhanced pension from 01.03.2023 after granting him promotion to Grade-2 with effect from 24.12.2015 under the Rules of 1993.

Learned counsel for the petitioner submits that suffice it would

be if a direction is given to the respondents to dispose of the representation of the petitioner.

Learned counsel appearing on behalf of the State submits that if

the petitioner files a fresh representation before respondent No.3, his case will be considered and an appropriate order will be passed.

Considering the said submission, I direct the petitioner to file a fresh representation before respondent No.3The District Superintendent of Education, Lohardaga within a period of four weeks, who will consider the claim of the petitioner within six weeks thereafter and if it is necessary to place the case before any committee or any authority, the same should be place during the said period.

If the petitioner is entitled for any relief, the same will be granted within four weeks thereafter. If any part of the claim of the petitioner is rejected, the reasons thereof should be communicated to the petitioner within the aforesaid period.

With the aforesaid observations and directions, the instant writ petition stands disposed of.
