1. Heard the learned counsels appearing on behalf of the parties.
2. This writ petition has been filed for the following reliefs: -
3. The learned senior counsel for the petitioners has submitted that the matter revolves around legality and validity of adoption of Ramdhani Bhagat by Hernarain Bhagat. He submits that the aforesaid point was subject-matter of consideration in S.A. No. 204/2007 arising out of Title Suit No. 70/1974 and the said Second Appeal No. 204 of 2007 has been remanded to the learned 1st appellate court vide order dated 27.01.2026. The learned senior counsel has also submitted that the Second Appeal was filed by Ramdhani Bhagat, who is the original writ petitioner even before this Court.

The learned counsels for the parties jointly submitted that ultimately the issue arising in this case will also get settled once the point regarding adoption of Ramdhani Bhagat by Hernarain Bhagat is settled. The learned counsels jointly submitted that there is no point keeping this writ petition pending. It may be observed that the parties may take appropriate steps depending upon the final outcome of the matter regarding adoption which is now pending before the learned 1st appellate court on account of remand order passed in 2nd appeal.

Considering the submissions and with the consent of the learned counsels for the parties, this writ petition is disposed of observing that the parties may take appropriate steps once the matter regarding adoption of Ramdhani Bhagat (the original petitioner of this case) is ultimately settled in the proceeding arising out of Title Suit No. 70/1974 which is now pending before the learned 1st appellate court.
