The instant writ application has been preferred by the petitioner praying for a direction upon the respondent-authorities to allow the petitioner to work as Poshan Sakhi of her village in accordance with the decision of the Gram Sabha.

The case of the petitioner is that she was selected for the post of Poshan Sakhi but after the decision of the Gram Sabha, an objection was filed by the private respondent (5^th Respondent) that she belongs to the same village and she is also a Graduate. The committee came to a decision to consider the objection of the 5^th Respondent. Thereafter the committee verified the objection and the documents supplied by the 5^th Respondent which indicated that the petitioner was an Intermediate, whereas; the 5^th Respondent was a Graduate. Thereafter, considering all rules and

regulations, residential certificate and the marks obtained by the 5^th Respondent which is higher than the petitioner, the respondent-State appointed 5^th Respondent as Poshan Sakhi.

The grievance of the petitioner in the writ application is that the 5^th Respondent has made an objection after a long time; however, the same has been rebutted by the respondent-State in paragraph no. 12 of its counter affidavit wherein it has been stated by the respondent-State that objection was received within stipulated time. The said statement in the counter affidavit has not been refuted by the Petitioner, either by way of reply or before this Court during submission.

4. Having regard to the aforesaid facts and circumstances of the case that the 5^th Respondent is more educated and she also belongs to same village, I do not find any error in giving appointment to the 5^th Respondent. Accordingly, no relief can be granted to the petitioner.

5. As a result, the instant writ application stands dismissed.
