03/ 30.06.2026: Heard, learned counsel for the parties.

By way of filing this writ petition, the petitioner has sought for the following reliefs:-

“For issuance of an appropriate writ, order or direction to stay the execution proceeding arising out of J.B.C. Case No.15 of 2020 filed by the respondent No.4 for eviction of the petitioner from the House No.M/5 (Double Storey), Harmu Housing Colony, Argora which in possession of the petitioner.”

It is grievance of the petitioner that their appeal against eviction was heard and judgment was reserved, but in the meantime, the Executing Court had already fixed a date to get the property premises vacated and also taken all steps to evict the petitioner from the premises forcibly.

On the last date, this Court directed the State to inform as to what is the status of the appeal.

Today, both the learned counsels appearing on behalf of the petitioner and respondents admits that the appeal has been dismissed

on 22.06.2026.

Mr. Indrajit Sinha, learned counsel appearing on behalf of the petitioner submits that there is statutory remedy of Revision available to the petitioner and his clients will pursue it by filing Revision immediately. He submits that the next date fixed in Execution Case is 01.07.2026 and there is high probability that an appropriate order will be passed in the Execution Case.

Considering the said submissions of both the parties, it is made clear that petitioner should file revision till 06.07.2026 along with the petition for stay of the Execution Case, which will be considered independently on the merits of the case by the Revisional Authority by 10.07.2026. It is expected that the landlord will also appear in this case on the date fixed.

Till, 10.07.2026 no coercive steps shall be taken against this petitioner.

In the meantime, along with Revision Application amount of Rs.50,000/- should be deposited.

With the aforesaid observation, the instant writ petition stands disposed of.
