By filing this writ petition, the petitioner has prayed for

the following reliefs:-

“(i) For issuance of an appropriate writ(s)/order(s)/direction(s) particularly a writ in the nature of mandamus directing the respondent no.2 and 3 to take appropriate action against the respondent no.4-6 who have issued land possession certificate (Bhumi Sambandhit Praman Patra) to respondent no.7 on 02.03.2019 with respect to lands situated at Village Daru, Jabra pertaining to Thana no. 201, Khata no.118, ad measuring an area of 4.05 acres without the

knowledge of the petitioner and in pursuance of which the respondent no.5, out of the aforementioned 4.05 acres of land has sold approximately 1.31 acres of land to respondent no.8 vide sale-deed no. 3934 dated 22.06.2019/ 25.07.2019 showing the petitioner as dead and thereafter, rent receipts have been issued in favour of the respondent no.8;

And / Or

(ii) During the pendency of writ petition an order of status quo may kindly be passed with respect to the disputed land situated at Village Daru, Jabra pertaining to Thana no. 201, Khata no.118, ad measuring an area of 4.05 acres.”

2. Heard learned counsel representing the petitioner and learned counsel representing the respondents.

3. It is the grievance of the petitioner that his son, who is private respondent No.7 in this writ petition, showing him to be dead, has transferred the land to his wife through Sale Deed.

Mr. Afaque Rashidi, learned counsel representing respondent No.7 - son of the petitioner, submits that a criminal case has already been initiated and he also admits that the respondent No.7 has shown his father (petitioner herein) to be dead, while transferring the land to his wife through Sale Deed.

5. Learned counsel representing the petitioner submits that only grievance of the petitioner at this stage is that the respondent– State should take a decision in light of the recommendation made by the Circle Officer, Daru, Hazaribag, which is Annexure-C to the counter affidavit.

6. Considering the aforesaid submission, since there is

already a recommendation, I direct the respondent – State to take a decision on the recommendation made by the Circle Officer, Daru, Hazaribag, and pass an appropriate order and communicate the same to the petitioner and respondent Nos.7 & 8. Once the decision is taken, consequential action must be taken pursuant to the said decision at the earliest, within a period of twelve weeks from the date of receipt of copy of this order.

7. Since the petitioner is a senior citizen aged about 79-80 years, it is expected that his son (respondent No.7), will not take any step to oust him from the property in question. If there is any threat, liberty is reserved with the petitioner to immediately approach the local Police, who will take appropriate action.

8. With the aforesaid observation and direction, this writ petition stands disposed of .
