It is the grievance of the petitioners that their membership of the Indian Red Cross Society, Deoghar District Branch has been cancelled whimsically.

The grievance of the petitioners is that more than one thousand persons were inducted as members, but thereafter a scrutiny was conducted and in respect of some persons, it was found that their admission as members was not proper. It was further found that many of them have not paid their requisite fees nor they knew about the fact that they were inducted as members of the society. On this ground memberships of the petitioners and all others were cancelled.

The petitioners challenged the same submitting that the petitioners were aware that they were members and they deposited the fees but without assigning any individual reason, in mass scale, the memberships of the inducted members including the petitioners were cancelled.

Learned counsel for the State submits that many persons were inducted as members of the society but they were not aware that they were so inducted and they did not pay the fees also. Thus, it was presumed that there was large scale irregularity in induction of the members of the society.

Considering the submission of the parties and fact that the petitioners have already deposited the membership fees of the society and also applied for the same, prima facie , it cannot be said that they were not aware that they were being inducted as members in the society. Thus, the case of the petitioners needs to be individually scrutinized.

In view of the aforesaid facts, I direct the petitioners to file proper application before the District Magistrate-cum-President of the Indian Red Cross Society, who

will get the documents of the petitioners scrutinized by a committee formed by him, and if it is found that there was no irregularity and illegality in inducting the petitioners as members of the society, their memberships will be restored within twelve weeks from the date of receipt of a copy of this order.

With the aforesaid observation and direction, this writ petition stands disposed of.
