Thirty-five petitioners sought a direction upon the respondent-authorities (JSMDC and its officers, plus the Secretary, Department of Mines & Geology) to act in accordance with their own resolution dated 04.03.2010 (Annexure-2) and grant annual increments. 2. The instant writ application has been preferred by the petitioners praying for a direction upon the respondent-authorities to act in accordance with their own resolution dated 04.03.2010 (Annexure-2) and grant annual increments to the petitioners for which they are entitled.

3. Petitioners have earlier moved before this Court in W.P.(S). No. 1854 of 2009, which was disposed of by a Co-ordinate Bench of this Court vide order dated 10.11.2009, whereby the Co-ordinate Bench while disposing the writ application has directed the Managing Director of the Corporation to examine whether causal employees are also entitled to the increments which are given to the regular employees or not. Thereafter, pursuant to the aforesaid order, Annexure-2 was passed; whereby the concerned respondent has admitted that the persons in the list shall be entitled to admissible increments of pay in the said pay-scale of Rs.25503200, allowed to them vide office order No. 2295 dated 11.12.2002.

4. The grievance of the petitioners is that the said Annexure-2 has not been implemented or there is some calculation error.

5. Learned counsel for the petitioners fairly submits that the petitioners were regularized in the year 2010 vide notification No. 325 dated 04.03.2010 and all increments applicable on that day has been paid to them but there is calculation error.

6. Having regard to the aforesaid submission, interest of justice would be sufficed by giving liberty to the petitioners to approach the concerned respondent that if at all there is any calculation error in payment of increment pursuant to Annexure-2, then the same be rectified accordingly.

7. The petitioners would be at liberty to approach the concerned respondent, if so advised, by filing fresh representations. The moment the concerned respondent will receive any such representation(s), he shall take decision in accordance with law and applicable rules and regulations within a period of 12 weeks from the date of receipt of such representation(s).

8. It goes without saying that if the decision is taken in favour of the petitioners, the benefits as prayed by them in the instant writ application shall be extended to the petitioners, within a further period of 4 weeks.
