Jharkhand HC (Ranchi), W.P.(C) No. 2051 of 2019 (Ananda Sen, J.; decision dated 09.06.2026): Binod Ravi Das @ Binod Das had challenged the action of the Circle Officer, Chandrapura and the Land Reforms Deputy Commissioner, Bermo (Tenughat) whereby his long-standing jamabandi was recommended to be cancelled on the garb of initiation of a proceeding under Section 4(h) of the Bihar Land Reforms Act. Counsel submitted that vide order dated 11.03.2024 in Misc. Case No.4(h) 16/2022-23 the Collector-cum-District Magistrate, Bokaro had already set aside the Circle Officer and LRDC orders and remanded the matter for fresh decision; that no fresh decision had been taken nor had the petitioner been noticed; and that the petitioner remained in possession of the entire land in question. Finding that nothing remained to be decided as things stood, the Court disposed of the writ application with liberty to the petitioner to file an application or approach the Court afresh if any adverse order is passed pursuant to the 11.03.2024 order, and made clear that on remand the authorities must serve notice upon the petitioner and pass an appropriate reasoned order only after hearing the petitioner or his representative.

1. Heard the parties.

2. Learned counsel for the petitioner very fairly submits that vide order dated 11.03.2024, the Collector-cum-District Magistrate, Bokaro in Misc. Case No.4(h) 16/2022-23 has set aside the order passed by the Circle Officer and LRDC and has remanded the matter for fresh decision on the grounds mentioned therein. He submits that till date, no fresh decision has yet been taken nor the petitioner has been noticed. He very fairly submits that he is in possession of the entire land in question.

3. After hearing the parties, I find that in this writ petition, the petitioner has challenged the action of the respondents by which

his long standing jamabandi was recommended to be cancelled on the garb of initiation of the proceeding under Section 4(h).

4. Now since the order of the LRDC and Circle Officer has already been set aside vide order dated 11.03.2024 and a fresh decision has to be taken including the decision on whether 4(h) of Bihar Land Reforms Act is maintainable or not, I find that nothing remains to be decided in this case as things stand today.

5. This writ application is thus disposed of with a liberty to the petitioner to file an appropriate application or approach this Court if at all any adverse order is passed by the authorities pursuant to the order passed on 11.03.2024.

6. It is made clear that while passing an order on remand as directed vide order dated 11.03.2024, the authorities will serve notice upon the petitioner and only after hearing the petitioner or his representative, appropriate reasoned order can be passed.
