09/16.04.2026 The present appeal has been filed under Section 14 (A) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Heard learned counsel for the appellant and the learned counsel for the State as well as learned counsel for the victim.

The present appeal is directed against the order dated 25.07.2025 passed by the learned Additional Sessions Judge-I-cumSpecial Judge SC/ST Act, Dhanbad in Misc. Cr. Application No. 1911 of 2025 in connection with SC/ST Case No. 56 of 2025 arising out of Govindpur P.S. Case No. 235 of 2025 registered for the offence punishable under Section 64(2)(m), 115(2), 351(2), 352 of the BNS, 2023 and Section 3(1)(r)/3(1)(s) of the SC/ST (POA) Act whereby and whereunder the prayer of the appellant for grant of regular bail has been rejected. The case is presently pending before the learned Additional Sessions Judge-I-cum-Special Judge SC/ST(POA) Act, Dhanbad

It has been submitted by the learned counsel for the appellant that even as per the allegation, the appellant has established physical relationship with the victim on the false pretext of marriage. Both of them are major and as such, offence under the SC/ST is not made out. It has been further submitted that charge has been framed and one witness has been examined. The appellant is in custody since 14.06.2025. Based upon the aforesaid grounds, learned counsel for the appellant has submitted the appellant deserves to be enlarged on bail.

Learned counsel for the victim has opposed the prayer for bail.

¶15

Considering the fact that both the parties are major, I am inclined to enlarge the appellant on bail.

Accordingly, the appellant, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I-cum-Special Judge SC/ST(POA) Act, Dhanbad in connection with SC/ST Case No. 56 of 2025 arising out of Govindpur P.S. Case No. 235 of 2025, subject to condition that the appellant(s) will submit self-attested photocopy/photocopies of his/her/their Aadhaar Card(s) and also submit his/her/their mobile number(s) before the learned trial court which he/she/they will always keep active and will not change it during pendency of this case without prior permission of the court.

In the result, the present appeal is allowed.
