1. Heard the parties.
2. The present Criminal Appeal has been preferred against the order dated 27.07.2022 passed by the learned Special Judge SC/ST-cum-Additional Sessions Judge-I, Garhwa, in SC/ST Case No.02 of 2023 arising out of Ranka P.S Case No.247 of 2021 whereby and whereunder the learned Trial Court has been pleased to find a prima facie case for proceeding under Section 323, 341, 353, 504/34 of the IPC and under Sections 3(1)((s) of the SC/ST (PoA) Act against the accused persons and accordingly, cognizance has been taken vide order dated 09.05.2022 and summons have been issued to the appellant for facing the trial.
3. After some arguments, learned counsel for the appellant seeks permission to withdraw the present criminal appeal with a liberty to approach the Trial Court by filing discharge petition or taking any other appropriate measure as permissible under law.
4. Learned counsel for the other side has raised no objection.
5. Permission is granted. Accordingly, the present criminal appeal is hereby,
disposed of with the aforesaid liberty.
6. Pending I.A, if any, also stands disposed of.
