In pursuance of the order dated 02^nd April 2026 passed by this Court, an affidavit has been filed on behalf of the State.

Mr. Pankaj Kumar, learned Public Prosecutor representing the State, has submitted that this criminal appeal has been filed in terms of the order dated 14.09.1998 and 16.09.1998. It has been submitted by referring paragraph- 5 of the Affidavit filed by the State that the sole appellant, namely, Rup Narayan Sah has expired due to illness on 09.06.2025. The aforesaid statement has been supported by the death certificate dated 18.08.2025 as contained in Letter No. 246 dated 03.04.2026 issued by the Issuing Authority, Department of Economics & Statistics, Government of Jharkhand, which has been appended as Annexure-A and A/1.

Learned counsel for the appellant has submitted that the legal representatives of the sole appellant, namely, Rup Narayan Sah (now deceased) are not interested to pursue the appeal.

This Court, considering the fact of the death of the sole appellant, namely, Rup Narayan Sah as also the fact that the legal representatives of the sole appellant are not interested to purse the appeal, is of the view, that this appeal is abated.

Accordingly, this appeal stands abated and disposed of as such.
