Learned counsel for the petitioner submits that this interlocutory application has been filed with the prayer to amend the Cr.M.P. No. 1140 of 2024 by incorporating the additional prayer to quash and set aside the order dated 12.08.2024 passed in connection with Gonda P.S. Case No. 44 of 2021, corresponding to G.R. No. 2790 of 2022 whereby and where under, substance of accusation has been explained to the petitioner and also to quash and set aside the entire criminal proceeding arising out of Gonda P.S. Case No. 44 of 2021, corresponding to G.R. No. 2790 of 2022. It is next submitted that the proposed amendment was necessitated because of the developments which took place after filing of this criminal miscellaneous petition and the proposed amendment will not change the nature and character of this criminal miscellaneous petition. It is lastly submitted that unless the proposed amendment is allowed, the petitioner will be highly prejudiced.

Considering the aforesaid facts, the prayer for amendment made in this interlocutory application is allowed.

This interlocutory application is disposed of accordingly.

The learned counsel for the petitioner submits that the petitioner seeks permission of this Court to withdraw this criminal miscellaneous petition with liberty to raise the grounds mentioned in the petition at appropriate stage before the appropriate court.

This criminal miscellaneous petition is dismissed as withdrawn with the aforesaid liberty.
