The petitioner has moved this Court for grant of bail in connection with Koderma G.R.P.S. Case No.23 of 2025 registered for the offences punishable under sections 126(2)/ 115(2)/ 117(2)/ 109/103/61(2) of the B.N.S., 2023.

The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in criminal conspiracy with the co-accused persons has committed the murder of Aman Pandey and the petitioner has been implicated in this case only on the basis of CCTV footage and the self-confessional statement of the petitioner. It is next submitted that the allegations against the petitioner are all false and in the CCTV footage, it was found that there was free fight between the petitioner and the deceased and no weapon was used in the said scuffle and the witnesses whose statement has been recorded by the I.O. of the case have stated that, at the time of alleged scuffle, the deceased and the petitioner were in drunken condition therefore, the deceased fell down and became unconscious which goes to show that the petitioner had no intention to kill the deceased. It is further submitted that the petitioner and the deceased used to be friends and the reason for scuffle between the two was that the deceased

was forcing the petitioner to consume ganja which was not agreed to by the petitioner. It is then submitted that the petitioner has been in custody since 10.11.2025, as mentioned in paragraph no. 17 of the bail application and charge sheet has been submitted. It is next submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be admitted to bail.

The learned Addl. P.P. opposes the prayer for bail.

Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the abovenamed petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Dhanbad, in connection with Koderma G.R.P.S. Case No.23 of 2025 with the condition that the petitioner will cooperate with the trial of the case and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the trial of the case, with further condition that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
