The petitioner is apprehending his arrest in connection with Telaiya P.S. Case No. 336 of 2025, registered for the offence under Sections 272, 274, 275, 292 and 3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 47(a)(f) of Jharkhand Excise Act, pending in the court of learned Additional Chief Judicial Magistrate, Koderma.

Learned counsel appearing for the petitioner submits that the allegation of recovery of country made liquor is there from the house of one Dilip Yadav @ Dilip Kumar. He next submits that the said co-accused has taken the name of this petitioner. He further submits that the petitioner is having one criminal antecedent and disclosure to that effect has been made in para-12 of the petition, however, in that case also recovery has been made from other coaccused.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the name of the petitioner has come on the basis of confessional statement.
