02/ 18.02.2026 : Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Bariyatu P.S. Case No. 59 of 2025, registered under sections 303(2), 317(5) of BNS and section 21 MMRD Act, Rules 13 JM (PIMTS) Rules, pending in the Court of learned Judicial Magistrate, Latehar.

Learned counsel for the petitioner submits that petitioner is owner-cum-driver of hywa in question and allegation is made that 30 tonnes of coal was loaded on the said vehicle. He submits that petitioner has got no criminal antecedent which is disclosed in para 17 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that illegally the coal was being carried on the said vehicle.

Considering that petitioner is owner-cum-driver of hywa in question and allegation is made that 30 tonnes of coal was loaded on the said vehicle and petitioner has got no criminal antecedent which is disclosed

in para 17 of the petition and in that view of the matter, petitioner is directed to surrender before the learned court within two weeks from today
