02 /08.07.2026 Heard the learned counsel appearing on behalf of the parties.

2. Learned counsel for the petitioner submits that the petitioner is in custody since 23.04.2026 in connection with Giridih (M) P.S. Case No.188 of 2025, corresponding to G.R. No.1628 of 2026, for the offences registered under Sections 126(2)/115(2)/118/352/74/109/3(5) of the B.N.S. 2023, pending in the court of learned Sub-Divisional Judicial Magistrate, Giridih.

3. Learned counsel for the petitioner submits that the petitioner is in custody since 23.04.2026 and earlier he had moved anticipatory bail i.e. on 05.02.2026. The alleged date of incident is 01.07.2025. The learned counsel submits that one lady has been granted anticipatory bail through A.B.A. No.6710 of 2025, who happens to be the wife of the petitioner. The petitioner and his wife both had jointly moved the anticipatory bail application. The learned counsel further submits that as per the F.I.R. there is no specific allegation against the petitioner and allegations are general and omnibus.

Learned counsel for the Informant has opposed the prayer for bail and has submitted that the informant could somehow save his life and he was assaulted at his neck by knife and the petitioner was avoiding his arrest for quite some time and he surrendered only on 23.04.2026. He has referred to the impugned order and submits that as per the impugned order itself, the witnesses vide paragraph 6, 7 and 8 have stated about specific allegation of assault against the petitioner

In view of the fact that as per the impugned order the witnesses vide paragraph 6, 7 and 8 have made specific allegation against the petitioner and the petitioner also has a criminal antecedent and is a named accused in the FIR, this Court is not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is hereby rejected.
