02 /08.07.2026 Heard the learned counsel appearing on behalf of the parties.

2. Learned counsel for the petitioner submits that the petitioner is in custody since 05.05.2026 in connection with Katkamdag P.S. Case No.46 of 2026, for the offences registered under Sections 137(2), 127(2), 64(2)(m), 351(2) of the B.N.S. 2023 and sections 8, 6 of the POCSO Act, pending in the court of learned Additional Sessions Judge-IV-cum-Special Judge POCSO, Hazaribagh.

3. Learned counsel for the petitioner submits that petitioner is in custody since 05.05.2026 in connection with F.I.R. which was lodged on 07.04.2026. The learned counsel submits that the present case, which has been lodged on 07.04.2026 is a counterblast to the case registered at the instance of the petitioner on 07.04.2026, when the petitioner was in the hospital as the victim and her family members had assaulted him due to which he was hospitalized.

The learned counsel further submits that as per the FIR lodged by the petitioner, the petitioner had met with the victim and the victim had requested him to drop her in Hazaribagh and this happened on 02.04.2026 and thereafter, on 03.04.2026 he received a call from the victim that she had no means to come back and while petitioner was going to Hazaribagh to bring her back, he was assaulted on the way by the victim and her family members.

5. Learned counsel for the Informant has opposed the prayer for bail and has submitted that it is the case of the victim that the

petitioner had taken the victim on 02.04.2026 to Hazaribagh and raped her at Hazaribagh and somehow, she returned on 03.04.2026. The learned counsel submits that the victim is minor. He has also submitted that the fact that the petitioner had taken the victim to Hazaribahg on 02.04.2026 is admitted and there is no explanation as to what happened between 02.04.2026 and 03.04.2026.

After hearing the learned counsel for the parties and upon going through the aforesaid two F.I.Rs. and there is direct allegation against the petitioner that he had taken the victim to Hazaribagh on 02.04.2026 and raped her, this Court is not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is hereby rejected.
