2. Learned counsel for the petitioner submits that the petitioner is in custody in connection with Chandwa P.S. Case No. 37 of 2026, relating to Spl. POCSO Case No. 24 of 2026, for the offences registered under Sections 64(2), (M) of the B.N.S. 2023, pending in the court of learned Chief Judicial Magistrate, Latehar.

Learned counsel for the petitioner submits that the petitioner is in custody since 23.02.2026 and charge has been framed on 19.05.2026 for the alleged offence under Sections 64(2) (J) (M), 65(1) of BNS 2023 and under Section 4,6 of the POCSO Act. The learned counsel submits that as per the FIR itself the victim has stated that the petitioner belongs to the village of the victim and since long, they were having relationship. It is alleged that on the pretext of marriage the petitioner established physical relationship with the victim and the FIR was lodged when the petitioner refused to marry the victim. In the FIR itself it has been mentioned that the petitioner was going to marry another girl. The age of the victim is disclosed in the FIR as 19 years.

4. Learned counsel for the informant has opposed the prayer and has submitted that the relationship is said to have started from the year 2020 and at that point of time the victim was just above 13 years of age.

5. The learned counsel for the opposite party-State has also opposed the prayer for bail.

6. After hearing the learned counsel for the parties and from the FIR it appears that the petitioner and the victim were having relationship since long and the FIR was lodged when the petitioner refused to marry. The charge has already been framed.

7. Considering the aforesaid facts and circumstances, the petitioner above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 25,000/- (Rs. Twenty-five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Latehar, in connection with Chandwa P.S. Case No. 37 of 2026, relating to Spl. POCSO Case No. 24 of 2026 on the following conditions:

(i) One of the bailors would be the present pairvikar of the petitioner.

(ii) The other bailor should be his close relative.

¶19

(iii) The petitioner will attend the court on each and every date and on account of his single default, the learned court shall cancel the bail bond furnished by the petitioner.

(iv) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court.
