2. Learned counsel for the petitioner submits that the petitioner is in custody since 15.01.2026 in connection with POCSO Case No. 48 of 2026 arising out of Bagodar P.S. Case No. 07 of 2026, for the alleged offence registered under Sections 137(2), 96, 3(5) of BNS and thereafter cognizance has been taken against the petitioner for offence under Section 96, 87, 64(1) of BNS and 4/6 of POCSO Act pending in the court of learned Special Judge POCSO Act, Giridih.

3. Learned counsel for the petitioner has submitted that the as per the first information report the victim was found missing, who was a minor. He has further submitted that the petitioner is 20 years of age having no criminal antecedent and in the impugned order itself reveals that the statement of the victim was recorded under Section 183 of BNSS wherein she has stated that she was 17 years of age and she was having love relationship with the petitioner since last five years. She has also stated that she had gone with the petitioner when the petitioner was under drunken condition. She has further stated that the petitioner put vermillion over her head and she wants to live with him. Learned counsel for the petitioner has submitted that apparently the case is of love affair between the petitioner and the victim.

4. Learned counsel appearing on behalf of the opposite party-State has opposed the prayer for bail. However, the aforesaid submission

made by the learned counsel for the petitioner, based on the material on record, is not in dispute. He has submitted that the victim was minor.

After hearing the learned counsel for the parties and considering the age of the petitioner and that the statement of the victim recorded under Section 183 BNSS as mentioned in the impugned order that she was in love relationship with the petitioner, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rs. Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge POCSO Act, Giridih in connection with POCSO Case No. 48 of 2026 arising out of Bagodar P.S. Case No. 07 of 2026 on the following conditions:

(i) One of the bailors would be the present pairvikar of the petitioner.

(ii) The other bailor should be his close relative.

¶20

(iii) The petitioner will attend the court on each and every date and on account of his single default, the learned court shall cancel the bail bond furnished by the petitioner.

(iv) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court.

(v) The petitioner shall fully co-operate with the proceedings before the learned court below.

6. The instant bail application is allowed with the aforesaid conditions.

7. Let a copy of this order along with a copy of the affidavit filed with the bail petition be communicated to the court concerned through ‘FAX/E-mail’.
