Case No.15 of 2021 registered under Sections 364, 120B, 34 of the Indian Penal Code, on the allegation that he, in criminal conspiracy with co-accused, kidnapped Dhananjay Mishra and committed his murder. Counsel submitted that the petitioner, though not named in the F.I.R., was implicated through confessional statements of the accused persons, has no criminal antecedent (para-19 of the bail application), that the chargesheet has been submitted, that a similarly placed co-accused was already admitted to bail by a co-ordinate Bench vide order dated 26.04.2022 in B.A. No.330 of 2022, and that the petitioner has been in custody since 17.03.2026. Heard the parties.

The petitioner has been made accused in connection with Mirzachouki P.S. Case No.15 of 2021 registered for the offences punishable under Section 364, 120B, 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner, in criminal conspiracy with the coaccused persons, kidnapped Dhananjay Mishra and committed his murder. It is submitted that the allegation against the petitioner is false. Drawing attention of this Court towards para-19 of the instant bail application, learned counsel for the petitioner submits that the petitioner has no criminal antecedent. It is further submitted that though the petitioner is not named in the F.I.R. yet the accused persons of the case in their confessional statement, have implicated the petitioner in this case. It is also submitted that chargesheet has already been submitted in this case. It is next submitted that the co-accused, with similar allegations, has already been admitted to bail by a co-ordinate Bench of this Court vide order dated 26.04.2022 passed in B.A. No.330 of 2022. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case and that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. It is lastly submitted that the petitioner has been in custody since 17.03.2026 as

has been mentioned in para-01 of the instant bail application. Hence it is submitted that the petitioner be released on bail.

Learned Addl. P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/(Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sahibganj in connection with Mirzachouki P.S. Case No.15 of 2021 with the condition that he will cooperate with the trial of the case, furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
